Nielson, Nielson Law Office, and Warren Agin, Swiggart & Agin, LLC, will lead a discussion of e-discovery and retention issues, analysis of the e-discovery, and the inherent difficulties and expense involved, and admissibility of the records. The program will cover a brief history of e-discovery and the burden on counsel to become familiar with ESI of their clients, knowledge of electronic formats and retention requirement, and its use in bankruptcy proceedings, especially in adversary proceedings.
