Brennick v. Brennick, 11-P-1430
Counsel for the Wife in a contempt action was ordered to pay $500 personally for bringing a frivolous complaint for contempt against the Husband. While the trial court’s reliance on Krock v. Krock and G.L. c. 208, § 38 may have been misplaced as they arguably relate to fees against parties, the trial court was well within its inherent power to sanction attorneys personally. There was no abuse of discretion in the sanctions ordered or the finding that the Wife’s complaint was frivolous.
