BBA's Annual Workshop for Public Sector Labor Relations Specialists Turns 40

This year marks the 40th anniversary of the BBA’s Annual Workshop for Public Sector Labor Relations Specialists. Sponsored by the Labor & Employment Law Section, the program is co-chaired by Peter J. Berry of Deutsch Williams Brooks DeRensis & Holland, P.C., Amy Laura Davidson of Sandulli Grace, P.C. and Marc D. Greenbaum, Professor of Law at Suffolk University Law School.  The program will be held on Saturday, May 4, 2013 from 9:00AM to 12:30 PM at Harvard Law School (Langdell Hall, Vorenberg Classroom)

Over the past forty years, this workshop has become the premier educational and networking opportunity for practitioners from all branches of public sector labor relations practice in Massachusetts.  The program draws attendees from all areas of public sector labor relations.  The panelists are also drawn from a similarly wide sampling of the labor relations realm;  including state agency representatives and decision makers, practitioners who represent employees, unions and laborers,  as well as those who typically represent management.  

Workshop Co-Chair Marc D. Greenbaum will open the program with a presentation concerning Significant Labor Law Decisions of the Supreme Judicial Court and the Appeals Court over the past year.  This keynote address will be followed by a session subtitled “Looking Forward At 40” focused on recent developments and issues being handled at the agency level in Massachusetts. 

Marjorie Wittner, Chair of the Commonwealth Employment Relations Board, will present along with Commonwealth Employment Relations Board members Elizabeth Neumeier and Harris Freeman.  These panelists will discuss recent trends in the types of charges filed at the agency and will provide a review of recent decisions.   Erica Crystal, Director of the Department of Labor Relations (DLR), has instituted a series of new initiatives aimed at reducing backlog and assisting parties to settle their disputes without litigation. The DLR has also adopted a new scheduling procedure along with a new unilateral settlement procedure. The panel will also include Jane Gabriel, Chief Counsel to the Department of Labor Relations, and workshop Co-Chair Amy Laura Davidson, a Member of the Advisory Council of the Department of Labor Relations. Ms. Crystal will also provide information concerning trends in cases at the Joint Labor Management Committee.

The second session, subtitled “Cross At Your Own Risk: Red Light / Green Light – How Neutrals Decide Cases” will feature arbitrators Joan Dolan, Paul T. Edgar, and Harvey M. Shrage.  The arbitrators will weigh in on how they would rule on a variety of hypotheticals presented by attorneys Elizabeth Valerio of Deutsch Williams Brooks DeRensis & Holland, P.C., James A. Toomey of Murphy Hesse Toomey & Lehane, LLP, Joseph G. Sandulli of Sandulli Grace, P.C. and Ryan Dunn, Staff Counsel to the Massachusetts Teachers’ Association.  This segment of the program offers attendees a unique perspective into the decision-making process of labor relations neutrals using the entertaining and illuminating “red light, green light” format.
