Massachusetts Attorney General’s Revised Debt Collection Regulations Two Years After Enactment

In March, 2012, the Massachusetts Attorney General’s revised consumer debt collection regulations became effective (940 CMR 7.00 et seq.). These regulations were amended to keep pace with changing technologies. They also created new obligations for creditors and debt buyers, including new validation requirements. Read on its own, the Wage Act is dense and difficult to understand. This has forced courts to delineate its boundaries through litigation. The trend has been pro-employee, with increasingly broad application of the act. Coupled with a fairly recent (2008) amendment making treble damages mandatory, this trend has substantially increased litigation in the area. For anyone interested in real estate or historical intrigue, this will be a unique experience. The Suffolk County Registry of Deeds is responsible for recording all documents relative to real estate, including deed, mortgages, releases, and liens, in the cities and towns of Boston, Chelsea, Revere and Winthrop. The Registry has been recording deeds since the early 1600's and provides access to these documents for the purpose of checking ownership and to see if a title is clear (e.g., no liens against it) before the buyer purchases property or land. Documents are indexed in books by grantor and grantee, and assigned a unique book and page number.
