Practical Implications of the SJC’s Ruling in Garrity v. Conservation Commission of Hingham

The Court’s decision provides valuable guidance for attorneys representing both applicants and conservation commissions, particularly with respect to waiving the Wetland Protection Act’s 21-day deadline for issuing orders of conditions after the close of public hearings. The decision also offers important instruction on court review of Enforcement Orders.
