Drafting Settlement Agreements that Work

Experienced employment lawyers will  share their best practices for drafting Settlement Agreements  in the employment context.  The panel will consider the recent Supreme Judicial Court decision in Crocker v. Townsend regarding the release of wage claims and provide an overview of the elements that should be considered and pitfalls that should be avoided when drafting settlement agreements, including: severance provisions, timing of payments, tax considerations, continuation of health benefits under COBRA, releases and exceptions, rehire clauses, restrictive covenants, confidentiality clauses, confidentiality of settlement agreement, cooperation provisions, ADEA and other review provisions, assignments clauses, merger clauses, references, clawback/forfeiture provisions, no disparagement provisions, liquidated damages, injunctive relief, arbitration provision, governing law, jurisdiction and venue.
