Preparing for Complex, Multi-Party Mediations

Description:

A discussion using realistic hypothetical situations (one a construction dispute and one a hybrid environmental/construction dispute) of how to plan for and conduct multi-party mediations. The focus will start with the planning stage and understanding the relationships between and among parties, including where one defense party may require contribution from and/or the consent of, another defending party, and where insurance coverage issues must be identified.

Subjects also include proper times for the initial joint session and following private sessions and managing the complex relationships among all parties, including the situation of where multiple defendants may have differing views on liability, damages and the resulting settlement value of the case as to each defendant. It includes when and how to explore the possibility of having the plaintiff reach separate settlements with one or more defendants.
