CLE - Healthcare Privacy and Security: Lessons Learned from Current Enforcement Trends

In recent years, there have been a number of Federal and State enforcement actions involving data breaches by healthcare providers in Massachusetts. These incidents and the resulting settlements provide insight into current enforcement objectives, how to prevent breaches, and the best ways to handle breaches when they do occur.

In this program, regulators from the Office for Civil Rights, the Office of the Attorney General, and a panel of healthcare attorneys who have experience representing healthcare entities in data breach matters will provide an update concerning regulatory activity in Massachusetts and New England.


I. New England and Massachusetts Regulatory Update
a.The nuts and bolts of Federal and State privacy and security law
b. Current enforcement priorities and objectives of federal and state Regulators, including an overview of recent enforcement activity, and how OCR and the AGO collaborate on enforcement activities
II. Lessons learned from recent activity in Massachusetts:
a. How to prevent and/or mitigate a breach
b. How to respond to a breach
c. How to handle settlement negotiations, including terms of a consent decree and traps for the unwary
