DPH's New Regulations Regarding Medical Use of Marijuana

Chapter 369 of the Acts of 2012 legalized marijuana for medical use by a qualifying patient with a debilitating medical condition who has a written certification from a physician.  Be prepared to understand DPH's broad reaching implementing regulations (105 CMR 725.000) effective May 24, 2013.  The new requirements impact physicians and patients, as well as the nonprofit dispensaries authorized by the law.  DPH's regulations address a wide variety of topics including but not limited to the physician-patient relationship, the two-phase application process to become a Registered Marijuana Dispensary (RMD), the cultivation, preparation, laboratory testing and dispensing of the supply, discounted  rates for low-income residents, secure home delivery, guidelines for personal caregivers, DPH's inspection and enforcement role, and advertising and packaging restrictions.  DPH will be setting application and registration fees shortly and providing guidance to applicants.  There will be a competitive application process in the summer and fall of 2013 for up to 35 RMDs statewide (at least one but no more than five per county). The regulations neither mandate nor prohibit involvement and regulation by cities and towns.
