The program provides an update on developments related to the Foreign Account
Tax Compliance Act (FATCA). Enacted in 2010, FATCA imposes new tax
documentation, withholding and reporting requirements on financial institutions
and other withholding agents (with new withholding rules to be effective as of
January 1, 2014). The new rules are targeted at banks and other financial
institutions but will also have a significant impact on multinational
corporations and investors having to deal with cross-border payments and funds
flows. In the update, we aim to provide some highlights from the final FATCA
regulations issued in January 2013, developments related to intergovernmental
agreements, the more immediate deadlines and the status of IRS guidance for
implementing the new FATCA regime.
