Copyright and Trademark on Campus: Fair Use, Course Ownership, and the College Brand

Zick Rubin and Brenda Ulrich will discuss recent legal developments in copyright and trademark law that affect colleges and universities. The topics will include:

  • The dramatically developing law on educational fair use of copyrighted materials in the classroom, online teaching, and electronic reserves.  Zick and Brenda will report on the latest act in the test case brought by a group of publishers against Georgia State University, being argued in November 2013 in the Eleventh Circuit Court of Appeals.  They will also provide practical tips on dealing with issues of educational fair use at a time when the law is in flux.
  • The percolating issue of faculty-member vs. institutional ownership of  copyright in college course syllabi and other course materials, especially in the context of on-line courses and MOOCs.
  •  Developments in the arena of colleges' promotion and protection of their names and "brands," especially in an era when students' and other consumers' research about colleges often begins with a Google search.  Zick and Brenda will discuss approaches to identifying and protecting an institution's most important marks, including trademark registration strategies.
