What Practitioners Need to Know About Recent Changes to the FINRA Arbitration Rules: All Public Panels, Cost-Shifting, E-Discovery, and Affirmations

Description:

For experienced and new practitioners, a panel discussion assessing recent changes to the FINRA Arbitration discovery and panel selection rules.  Specifically, the panel will discuss amendments empowering arbitrators to compel firms to produce documents and witnesses without use of subpoenas and allowing non-parties to object and seek cost shifting for producing documents and witnesses.  The panel will also examine the impact of all public or majority public arbitration panels and changes to the panel selection processes.  Finally, the panel will assess the amendments concerning e-discovery, discovery in investment product cases, and affirmations concerning searches for requested documents.
