Join us to learn about the rapidly-advancing implementation of the
voter-enacted Massachusetts law that authorizes state licensing of companies to
produce and sell marijuana products for medical purposes.
We will discuss the regulatory system that is being developed and implemented
by the Massachusetts Department of Public Health to review applications and
grant licenses to “dispensaries”.
We will also address the various responses by municipalities to affect the
location, operation, and impact of dispensaries through zoning bylaws and
ordinances, health regulations, and negotiated host community agreements.
Our panel will also discuss the legal issues facing dispensary operators in this
initial “roll-out’ period, including state licensing, municipal permitting,
private leases and site agreements for facility locations, and financial
operations for such entities, given the uncertain status of such operations
under federal law.
- Overview of the medical marijuana statute, state regulations, and the
implementation of the dispensary application and licensing system.
- Regulation at the municipal level, through zoning bylaws/ordinances,
health regulations, and negotiated agreements.
- Legal issues faced by dispensary operators, including obtaining state
licenses and municipal permits, determining appropriate locations, negotiating
leases, and addressing operational issues.
