Class action jurisprudence is changing rapidly, with courts in some
jurisdictions becoming more and more restrictive in how they address class
certification and class merits issues. Panelists on this CLE program will
discuss class action settlements in this new landscape, including recent
decisions on approving class settlements; mediation strategies; new approaches
to class notice and efforts to use new technology to reach more class members,
more effectively; dealing with objector litigation from both plaintiffs’ and
defendants’ perspectives; and ethical considerations in settling class actions,
on both sides of the table.
