Terrorism and the Material Support Statute: A Panel Discussion on the First Circuit’s Decision in United States v. Mehanna and Related Issues

In United States v. Mehanna the First Circuit issued one of the first notable decisions addressing the material support statute and terrorism following the Supreme Court’s decision in Holder v. Humanitarian Law Project.  In Humanitarian Law Project the Court, in a decision authored by Chief Justice Roberts, held that the First Amendment did not prohibit prosecution for speech that is coordinated with, or at the direction of, a designated foreign terrorist organization.  It is this standard that was critical in the Mehanna case.
