Intellectual Property Protection and the Exploitation of Fictional Characters

A character owner’s ability to exploit a character exclusively not only depends on the intellectual property protection available to that character, but also on how the character is used by others.  Understanding the legal protections afforded to fictional characters is important for both the creators of those characters, and those who want to make their own uses of those characters.

Our panelist will be discussing the exclusive rights afforded to owners of fictional characters through copyright and trademark law, and the ways in which the laws attempt to balance private property rights with the right of the public to enjoy the collective culture.
