Representing Debtors in Debt Collection Suits: Making Creditors Prove Ownership of Debts

Consumer debt collection cases are surprisingly complex. Cases commonly require analysis of federal lending and debt collection statutes and regulations, Massachusetts complimentary law, as well as common law contract principles. The key to these cases is usually found in the discovery process.

Seasoned debt collection defense practitioners, Thomas Beauvais and Danielle Spang, will discuss their strategies and insights for discovery in debt defense cases.

Specific topics will include:

  • What documents are necessary for the creditor/collector to meet their burden of proof
  • What requests are necessary to seek these documents
  • How to analyze the creditor/collector responses
  • How to guide clients through the discovery process
  • Filing Motions to Dismiss

In exchange for attending this free training, attendees are expected to sign up to volunteer at VLP’s Discovery Clinic (the second Wednesday of every month from 2-4 pm) at least two time during this year.  Attendees can also volunteer at the court project representing debtors in debt collection suits every Wednesday at 9 am.

Law students are welcome to attend and may be able to volunteer in limited circumstances.
