CLE - Medical Tourism: Legal Issues and Ethical Implications

Medical tourism provides patients with global access to good, affordable medical care. These procedures range from emergency surgery, to elective or cosmetic surgery. While there are benefits for these treatments, there are serious legal and ethical issues that need to be considered.

Learn about regulatory compliance and ethical issues governing international clinical trials, from patient recruitment to data privacy and informed consent. Our panelists will cover the liability, insurance and transactional issues related to medical tourism and representation of clients engaged in international healthcare work. Discussion of International Clinical Trials will include overview of the legal and ethical issues associated with the conduct of international clinical research.

Agenda:

  • Liability and Health Insurance Coverage  
    - Issues raised by medical tourism.
    - Difficulties faced by medical tourists from malpractice errors committed while abroad.
    - Legal and ethical issues incorporating medical tourism into health insurance plans.
    - Medical tourism and the Affordable Care Act.
  • Transactional Issues  
    - Respective motivations for this extension of American AMC
    - What U.S. law applies to the relationships being forged, especially financial regulations such as the Foreign Corrupt Practices Act. 
  • International Clinical Trials:  Regulatory Compliance and Ethical Considerations
    -An overview of the legal and ethical issues associated with the conduct of international clinical research
    -Topics will include; include (i)  unique clinical trial agreement issues; (ii) ethical issues, such as evolving views of informed consent, patient recruitment, post-trial access to investigational medicine and use of genetic information; (iii) significance of data privacy (iv); liability and insurance issues and (v) emerging trends, such as those proposed in recently introduced 21st Centure Cures legislation and the new EU Clinical Trials Directive.

The BBA is an accredited provider in Rhode Island, New York, California, Maine, and Vermont. If you need credit in another state for attendance for one of our accredited programs, we can provide you with a certificate of attendance to fill out for your jurisdiction. Forms certifying your attendance will be provided on the day of the program.
