Discovery in Fiduciary Litigation; Successfully Using Discovery as a Sword and a Shield

The lunch will feature a presentation and interactive Q&A about formal and informal discovery in probate and fiduciary litigation with a focus on how to use discovery to your client’s advantage.  We will review how various types of formal and informal discovery can assist litigators, including discussion of the following: (1) informal fact gathering; (2) witness affidavits; (3) conducting formal discovery; (4) effectively preparing to play offense or defense in depositions; and (5) discovering evidence on social media. 

The presentation will focus on a broad range of litigation ranging from straightforward estate/will contests to complex litigation involving institutional trustees.  We will discuss traditional written discovery, as well as frequent pitfalls involved in electronic discovery (and how to avoid them).

After this seminar, attendees will know how to approach discovery proactively to gain advantages in litigation (and settlement talks).
