What You Should Know About Post-Conviction Relief: How to Help Noncitizen Clients with Criminal Convictions

Mass. R. Crim. P. 30(b) can offer potent relief to criminal defendants for whom all other hopes have been exhausted, and the rule has increasingly become the focus of high-profile litigation in our appellate courts.   Motion practice under R. 30(b) is unusual insofar as it requires evidentiary skills associated with trial practice as well as an appellate-style command of a case’s record.  This training will provide an overview of the types of clients for whom R 30(b) litigation should be considered with a focus on relief for noncitizen clients. It will include major classes of claims for relief under the rule and practice pointers regarding the mechanics of drafting pleadings and conducting evidentiary hearings.
