Planning for Contested Estates: Estate Planning Strategies to Avoid (or Prevail In) Litigation

By the time litigation arises over an estate plan, the most critical legal steps that will determine whether the plan is ultimately invalidated or confirmed will have typically already occurred -- during the estate planning process.
This lunch will feature a presentation and interactive Q&A about estate planning strategies and best practices to be employed when a contest is possible or even likely.  Contests frequently arise when testator makes deathbed changes to his or her estate plan, or where mental capacity or undue influence are at issue.  We will focus on steps that can be taken during the planning stage to reduce the likelihood of litigation and to ensure that an estate plan, if challenged, will be upheld.  We will also discuss procedures that can be employed to try to achieve certainty and finality when litigation is anticipated.
