Employment Counterclaims: What They are, When to Bring Them and When Not To

Monday, April 10, 2017 12:00 PM to 1:00 PM
Boston Bar Association - 16 Beacon Street, Boston, MA

Description:

This program is a discussion about the substance and strategy surrounding the use of counterclaims in employment litigation, including discussion of: which counterclaims are “compulsory” and which are not; what strategic considerations apply to the decision to bring them in response to a complaint; and when the assertion of counterclaims can constitute illegal retaliation. After this seminar, attendees will know what counterclaims must be brought in order to avoid waiver; how to evaluate whether assertion of counterclaims may be retaliatory; and how to evaluate whether to bring counterclaims at all.
