SLAPP Happy: Tools and Tips for Navigating The Massachusetts Anti-SLAPP Maze

The Supreme Judicial Court just changed the anti-SLAPP rules: Do you know how this affects you and your cases?
 
This timely panel will discuss the ins and outs of anti-SLAPP litigation in Massachusetts, with a focus on the just-released decision (May 23) from the Supreme Judicial Court in Blanchard v. Steward Carney Hospital, Inc., which significantly alters the longstanding and well-known (but often litigated) Duracraft Corp. v. Holmes Prods. Corp. framework used by courts to decide anti-SLAPP motions in Massachusetts for the past two decades.
 
Get access to tips and tools for effectively, creatively and efficiently litigating anti-SLAPP motions in the uncertain terrain of the Blanchard decisional framework against the backdrop of the already ever-changing and sometimes inconsistent interpretations of the Massachusetts anti-SLAPP statute. The panelists are highly experienced litigators with firsthand experience in anti-SLAPP litigation in particular, including before the SJC and Appeals Court, and have each handled anti-SLAPP motions that involved novel and cutting edge issues.
They will cover, all in light of the SJC’s Blanchard decision:

  1. The current anti-SLAPP landscape, including the immediate practical and likely future implications of Blanchard, other new cases, trends in the appellate courts and upcoming cases.
  2. Tips on how to spot anti-SLAPP issues: what kinds of cases they come up in and how to evaluate a case with the anti-SLAPP statute in mind.
  3. The mechanics of the statute, the respective burdens on each side and of how to prepare and file anti-SLAPP motions and oppositions and supporting papers,
  4. Tips and tools for both moving parties and opposing parties to approach anti-SLAPP issues and to deal with them efficiently and successfully.
  5. Special tips and tools for small firms and solo practitioners dealing with and approaching these issues to use anti-SLAPP motions effectively, to best marshal resources and to avoid allowing anti-SLAPP issues to swallow the entire case.
