Reflections on Berkshire Power

Description:

Panelists will summarize and discuss the investigation and resolution of federal and state claims that the Berkshire Power Company (“BPC”) tampered with air pollution monitoring equipment at its Agawam, Massachusetts, plant and falsely reported data to environmental and energy regulators regarding its emissions levels and its availability to produce power. The investigation resulted in plea agreements under which BPC and its plant manager, Power Plant Management Services (“PPMS”), plead guilty to felony charges that they violated and conspired to violate the federal Clean Air Act. PPMS also plead guilty to charges that it violated the Federal Power Act—the first ever criminal charges under this statute—for making false statements to the regional power grid administrator, ISO-New England, regarding the plant’s availability to produce power. The parties also settled related state and federal civil claims.
