Insurance Agents and Brokers E&O Claims

Your client is sued only to discover that it has not purchased the appropriate or sufficient insurance to cover the claim. Your first thought may be to bring a declaratory judgment action against the insurance carrier. But have you considered whether a malpractice claim against your client’s insurance broker is also warranted? In order to properly advise your business or individual clients, lawyers must understand the duties of insurance agents in Massachusetts and trends in the area of insurance agent and broker errors and omissions claims.  

A panel of insurance agent E&O litigators and risk management professionals will discuss various claims that agency customers may bring against their insurance agents. We will review the applicable standard of care and frequently litigated areas, including: certificates of insurance, failing to advise a client to purchase specific insurance, and the agent as a fiduciary. A denial of coverage by your client’s carrier does not (necessarily) mean all is lost if your client’s agent breached the standard of care and its duty to your client.
