The Fundamentals of Opening and Closing a Probate Proceeding

Description:

The probate process can be a daunting experience for those new to this area of law or returning to probate practice for the first time following the enactment of the Massachusetts Uniform Probate Code. Attendees of this program will receive an accessible overview of the fundamentals involved in the process of opening and closing probate that is specifically geared to new practitioners or those new to probate law.  The class will encompass an analysis of the underlying issues of what is probate property, when probate is necessary, and what is accomplished by the probate procedure.  Attendees will be guided through the options for opening probate, including how to determine which option is most appropriate, forms, fees, notice requirements, timing, and practice tips. The program will conclude with a review of the options for closing a probate proceeding including consideration of the goals of the petitioner when deciding what option to use.
