European Patent Oppositions for US Lawyers

European patent oppositions provide the only opportunity to mount a single central attack on a European patent that is effective across all 38 member members of the European Patent Convention.  European companies have long deployed oppositions as a critical strategic tool in cross-border negotiations, global disputes, and for clearing the patent landscape in preparation for new products and innovations. Yet, the data shows that American companies, while accounting for a significant portion of patent activity in Europe, severely underutilize this important tool.  As Europe continues its rise as a forum of choice for high-stakes global IP disputes, U.S. companies and their legal advisors must adapt to the changing global IP landscape. 

In this session, we will break down the European patent opposition process from a U.S. perspective.  We will discuss differences and similarities between European oppositions and U.S. post-grant proceedings, the interplay between oppositions and national litigation, and strategies for effectively deploying oppositions as part of a global patent strategy.  Participants will also receive free copies of the book “The EU’s Unitary Patent and Unified Patent Court,” a reference guide to the proposed Unified Patent Court in Europe.
