Tackling Bad Faith Assertions of Patent Infringement in the Commonwealth

In an attempt to crack down on so-called “patent trolls,” Senator Eric Lesser has proposed Massachusetts Senate Bill S.128, “An Act to Protect Innovation and Entrepreneurship in the Commonwealth.”  If the bill passes, Massachusetts’ businesses who are targeted by bad faith assertions of patent infringement may be able to bring private actions against their accusers in Superior Court and recover damages and attorney’s fees.  Panelist Senator Lesser will discuss the proposed bill, its origins and potential limitations, other similar bills pending in the Massachusetts House and Senate, and the remaining obstacles to becoming a law that the bill may face.  Katie Rae, CEO and Managing Partner of The Engine, and Wendy Verlander, President and CEO of Blackbird Technologies will share their respective views on how this legislation may affect inventors, small businesses and emerging technology companies in Massachusetts.
