The Affordable Care Act (“ACA”) contains a game changing provision in State and Federal governments’ efforts to combat health care fraud.  Moving away from a “pay and chase” system, the government was granted the authority to suspend all payments to a health care provider upon identification of “credible allegations of fraud.”  This powerful tool to suspend payments can be implemented with little or no notice to the health care provider.  The consequences of payment suspensions can be devastating to health care providers, not only due to an abrupt termination of payments, but also the impact of the mandatory fraud referral to the State’s Medicaid Fraud Division.
