Public Sector on Strike

It is early 2018, and already the country has seen massive teacher strikes in West Virginia, Oklahoma, Kentucky, Arizona, and Colorado.  More are likely to come.  These strikes have broad implications not only for these states but for the nation as a whole.  They pose particularly interesting issues in Massachusetts, where high union density and historically strong teachers unions are coupled with a public sector labor law that prohibits public employees from striking.  This experienced panel of union and management attorneys will explore the political and legal contexts underscoring this moment, and offer perspective on where it may be going.  Issues will include the Supreme Court’s upcoming decision on public sector bargaining (Janus), implications for other public sector workers, 1st Amendment and preemption issues, and more.
