There is no denying that there has been an increasing amount of litigation under the theory of joint employment, particularly as employers are relying more and more on alternative workforces to meet the demands of growing business while managing personnel and overhead costs. On April 1, 2019, the DOL announced a proposed rule to revise and clarify the responsibilities of employers and joint employers to employees in an effort to fill the gap left by the administration’s repeal of the Obama administration’s 2016 informal guidance on joint employment.  Authoritative practitioners from both of sides of the bar will discuss the practical the implications of DOL’s recent proposed rule on companies and employees engaged in joint employment arrangements and the potential changes ahead for those litigating the underlying legal issues..
