Determination of Need (DoN) Reform in Massachusetts

In 2017, the Massachusetts Department of Public Health adopted landmark regulations with the goal of reforming the Determination of Need (“DoN”) Program to meet the policy goals addressing the Social Determinants of Health, controlling health care costs and ensuring equitable access to care that will improve public health outcomes.  In the two years since the regulations were adopted, the provider community has been tasked with navigating the new DoN process, with guidance from the Department, and how it impacts planning for capital expenditures.  Revisions to the new regulations were recently adopted that will continue to impact the way providers plan and implement new or expanded services, in furtherance of the regulation’s stated policy goals.  This Brown Bag lunch will offer insight into the policy behind the DoN Program’s new requirements, as well as the practical implications providers must consider when planning new services or capital expenditures.
