Charging and Defending Trustee Fees in Massachusetts: What is Reasonable?

Disputes over trustee fees can be hotly contested and disrupt efficient administration of the trust.  Trust instruments, however, rarely specify the level of trustee fees, other than to note that trustees are entitled to “reasonable compensation.”   Where the trust is silent, the MUTC similarly provides for the trustee to be paid compensation that is “reasonable under the circumstances.”  Under the circumstances, Trustees can face an inherent conflict of interest in setting and paying trustee fees to themselves.  

In this program, we will address charging and defending  trustee fees from several viewpoints, including that of a trustee,  a probate litigator, and an expert witness.   Learn different methods used by trustees to set their fees, the factors courts consider when reviewing fees for “reasonableness” and practical tips for avoiding and resolving trustee fee disputes.
