Conditional Guilty Pleas in Massachusetts

Description:

In August, 2018 in Commonwealth v. Gomez, the SJC recognized that defendants may enter conditional guilty pleas to reserve appellate rights on substantial pretrial motions. The SJC Standing Advisory Committee has proposed an amendment to Rule 12 of the Rules of Criminal Procedure, to replace the temporary rule announced by the SJC in its decision in Gomez.

This program will explain both the temporary and proposed permanent rule, discuss common issues that can arise in entering these pleas, and offer a how-to for this novel procedure. This program will be essential for state criminal practitioners, and will offer the insight of experienced federal criminal litigators as well as a view from the bench. There will be written materials provided.
