Smith v. Westfield: Article 97 A Year Later

It has been just over a year since the Supreme Judicial Court (“SJC”) clarified its opinion on the interpretation of restrictions under Article 97 of the Amendments to the Massachusetts Constitution, which prohibits changes in use or ownership of property taken for recreation or conservation without legislative authorization. In Smith v. Westfield, the SJC distinguished its 2013 Mahajan v. Department of Environmental Protection opinion and acknowledged that there are circumstances where property may be protected by Article 97 without recorded restrictions. In this program you will hear from attorneys who participated in the case about the issues that led to the Court’s decision and how the new rule has been applied over the previous year.
