The IP Decisions From the Supreme Court This Term: What You Need to Know

2019 was an active year for IP decisions at the Supreme Court. The Court has either decided or is scheduled to decide issues related to patents, copyrights, trademarks and licensing. Our panel of some of Boston’s top IP litigators will break down the decisions, including these topics:

  • Whether confidential sales may qualify as prior art after adoption of the AIA
  • Whether the government is a “person” who may petition to institute review proceedings of an issued patent under the AIA
  • The date on which copyright registration is effective for purposes of bringing an infringement action
  • What costs are recoverable by a prevailing party under the Copyright Act
  • Clarification of the treatment of Trademarks as “intellectual property” under the Bankruptcy Code
