Bankruptcy and Commercial Leasing – Issues Every Real Estate Attorney Should Know

With national and regional retailers filing for bankruptcy protection at astonishing rates, landlords, lenders, and tenants are assessing the ways in which a bankruptcy will affect their real estate portfolio.  

Our panelists regularly represent creditors in bankruptcy and frequently advise both commercial landlords regarding tenants in financial distress as well as commercial tenants about how their leases will be treated in bankruptcy.  They will do a brief overview of key bankruptcy concepts relevant to commercial leasing attorneys, including the rejection of leases, treatment of cash security deposits versus letters of credit, cap on Landlord damages, and the automatic stay.  They will also discuss some recent trends they are seeing in their practices that could impact both landlords and tenants. 

Attendees of this program will gain insight and learn specific approaches from the perspective of different commercial real estate stakeholders in handling distressed tenants.
