Revisiting the Restatement: How Will The ALI’s Restatement of Law, Liability Insurance Impact Your Practice?

On May 22, 2018, after eight years of debate and controversy, the American Law Institute approved the final text of the Restatement of Law, Liability Insurance.   This Restatement, which is the first ALI project to be devoted to a single industry, has drawn fierce opposition from many insurers and state insurance regulators, who contend that it goes far beyond the accepted common law in most states and proposes novel approaches to insurance coverage issues that do not belong in a “Restatement” of the law.   It remains to be seen how courts will embrace this Restatement in the same consequential manner as past ALI projects, such as the Restatements of conflicts of law, contracts and torts.

Morrison Mahoney’s Mike Aylward, who was one of the ALI Advisors on this Restatement, will join us to explain the important differences between Massachusetts law and the Restatement. He will also discuss how the Restatement has been received in other jurisdictions, and offer his thoughts on whether Massachusetts is likely to adopt any aspect of the Restatement.

Joining Mike will be Kim Marrkand of Mintz, who advises insurers on the business and legal implications of coverage issues. Kim will discuss the Restatement from the perspective of the insurance industry.
