Joint Defense Agreements, or JDAs, have been making the news recently, but white collar practitioners have been entering into JDAs long before they were a popular topic among the national press corps.  When your client faces a government investigation or enforcement action, you may well consider entering into a JDA with others similarly situated.  Every JDA is different, however, and practitioners should ask:  When is it beneficial to enter into a JDA?  Are you sure yours is enforceable?  What happens if your client or someone else in the joint defense group decides to leave?  And, what we’ve all been wondering: could Paul Manafort really maintain a JDA after pleading guilty and cooperating with the government? 

In this White Collar Practice Series program, Tony Fuller, Vanessa Arslanian, and Mike Licker will provide a primer on JDAs in the white collar context and answer any questions you have about them.  Participants should expect to come away with an understanding of how to enter into an enforceable JDA, current law on this issue, and the suite of considerations counsel should consider in the joint defense context.
