Section 35 Commitments: the Rights of the Respondent and the Civil Rights Implications

Description:

What happens when someone files a Section 35 petition? Who may file one and when? And what rights does the respondent have? This program will answer these questions and more, with a look at the recent Section 35 Commission Report. This program will also address how recent civil rights decisions under the Americans with Disabilities Act may impact the rights of respondents. This program will also look into the civil rights implications of involuntary commitment.

Attorney Jessica Gallagher is a criminal defense attorney with extensive experience representing respondents at Section 35 Petition Hearings and who testified before the Section 35 Commission. Attorney Jessie Rossman sat on the Commission and has focused her work with the ACLU on the civil rights of those affected by Opioid Use Disorder.
