GPS Monitoring in Massachusetts

Over 4,000 defendants and probationers are now subject to GPS monitoring across Massachusetts. Judges have increasingly relied upon this technology both pretrial and post-disposition. And the SJC has a number of recent decisions, plus cases currently pending, that address the constitutional issues involved in the attachment of a GPS device and the availability of the data from those devices. Issues related to GPS monitoring arise frequently, but are often misunderstood.

At this event, a diversity of experts will discuss these issues from all sides. General Counsel for the Probation Service and the Statewide Manager of the Electronic Monitoring Program will each provide guidance on how the GPS monitoring program works and how it is supervised from the monitoring station in Clinton. Next, the prosecutor and defense attorney who litigated the recent Feliz case in the SJC about GPS monitoring will offer practice pointers for attorneys litigating these issues. This event will be indispensable for prosecutors and defense attorneys who confront issues arising from GPS monitoring in their practice, both at the trial court level and on appeal.
