Class Certification in the First Circuit After Asacol

On the eve of trial in an antitrust class action alleging that a pharmaceutical company engaged in an unlawful product hop that delayed the entry of generic drugs into the market, the First Circuit Court of Appeals granted the company's petition for interlocutory review of the trial court's class certification decision and stayed the impending trial. The resulting First Circuit opinion vacating the decision has and will continue to have a major impact on the ability of plaintiffs to certify consumer classes in which consumer coercion is alleged. This program, presented by counsel in the case, will explore the First Circuit's opinion in In re Asacol Antitrust Litigation, 907 F.3d 42 (2018) and the impact of this landmark opinion.
