Microsoft's Challenge to the Presumption of Validity in Microsoft v. i4i Limited Partnership

Panelists Mark B. Solomon, Hamilton, Brook, Smith & Reynolds, PC, Greg Sieczkiewicz, Flagship Ventures, and Jack C. Schecter, Sunstein Kann Murphy and Timbers, will lead a discussion of the Federal Circuit's decision to hear Microsoft's challenge to the presumption of validity in Microsoft v. i4i Limited Partnership. They will also discuss the competing arguments for and against a revision of the traditional presumption of validity and explore the potential implications of a revision of this presumption for the patent prosecution process, patent valuation of issued patents, and litigation strategy. Panel members bring experience from all relevant areas of analysis: patent prosecution, valuation, enforcement, and defense.
