In recent years, scores of business disputes have opted out of the courthouse choosing instead a commercial arbitration forum. Commercial arbitration offered a simpler, cheaper, faster, private, and more final process that allowed parties greater schedule control and a choice of decision-maker. But has commercial arbitration become a victim of its own success? Has the import of more and more aspects of traditional litigation, including injunctive relief, discovery, and motion practice, sacked the process of its benefits?

Hon. Allan Van Gestel, ret. of JAMS, and Catherine Shanks, Vice President, American Arbitration Association, will offer their views and their suggestions on how to improve the efficiency and effectiveness of commercial arbitration.
