Privacy and Privilege When Communicating With Clients Via Email

Description:

Sara Jane Shanahan, litigation partner at Sherin and Lodgen LLP, and Debra Squires-Lee, a litigation partner who specializes in legal malpractice defense at Sherin and Lodgen LLP, will discuss recent case law and ABA Ethics Opinions relating to email communications with clients. In particular, Formal Opinions 11-459 and 11-460 issued by the ABA's Standing Committee on Ethics and Professional Responsibility this summer address: (1) an attorney's ethical obligations and duty of care when communicating with a client via email or other electronic means; and (2) an attorney's ethical and legal obligations when receiving copies of a third party's email communications with counsel.
