Successful resolution of a civil claim, whether through pre-suit negotiations or trial, requires efficient and effective pre-trial case management. Lawyers must be able to evaluate the merits of a claim and its defenses before trial. Techniques including witness interviews, evidence inspections, informal discovery, internet research and expert opinions may help to resolve a claim before suit is filed.

Should the parties be unable to resolve a claim before suit is filed, the finer points of civil procedure, including complaints, requests for injunctive relief, Mass.R.Civ.P. 34 Requests, interrogatories, depositions, and admissions must be employed to streamline the matter for trial. In doing so, the parties are also preparing for the serving of dispositive motions and their oppositions.

Seasoned practitioners from the plaintiff’s and defense bar will present their perspectives on the progression of claims leading up to trial. The panel will present practical advice and examples which attendees may use in developing a litigation plan to maximize their client’s case.
